THE TERMS AND CONDITIONS OF THE ONLINE SHOP WWW.MOKOBELLE.COM
These Terms and Conditions are effective as of 25th February 2021.
These Terms and Conditions set out the terms and conditions for sales through the online shop www.mokobelle.pl by 7stones sp. z o.o. with its registered office in Warsaw, and define the terms and conditions for the provision of free electronic services by 7stones sp. z o.o. with its registered office in Warsaw.
I. General Provisions
1. Definitions:
Personal Data Controller - 7stones spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw at ulica Dominikańska 21 B, 02 - 738 Warsaw; entered in the Register of Entrepreneurs of the National Court Register as KRS number 0000381840, registered in the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, NIP (taxpayer identification number): 521 359 92 36, REGON (National Business Registry Number): 142878397;
Delivery time - the time in which the Seller completes the order and forwards it to the Supplier executing the form of delivery selected by the Customer;
Business days - the days of the week from Monday to Friday, excluding public holidays under applicable laws;
Supplier - a company specialising in supplying shipments selected by the Seller for delivery of goods to Customers;
Proof of purchase / proof of transaction - a receipt, VAT invoice or other proof of purchase of the Goods;
Customer - a natural person with full legal capacity, and in the cases provided for by the generally applicable provisions also a natural person with limited legal capacity, a natural person running a business, legal person or organisational unit without legal personality, placing Orders in the Online Shop;
Consumer - a natural person making a legal transaction not directly related to their business or professional activity, and from 1st January 2021 also a natural person conducting business activity on the basis of an entry in the Central Register and Information on Business Activity (CEIDG), concluding an agreement directly related to their business activity, but not having a professional character resulting from the subject of their business activity;
Customer Account - a personalised account created for the Customer following their registration on the Online Shop Website;
Newsletter - a service provided electronically by the Seller, which provides interested buyers with the automatic delivery of information relating to the Online Shop via email;
Entrepreneur - natural person, legal person or organisational unit without legal personality running a business in its own name;
Terms and Conditions - these Terms and Conditions for the provision of services electronically via the Online Shop operating at www mokobelle.pl;
GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
Website - means the web pages, under which the Seller conducts the Online Shop;
Online Shop (Shop) - the online shop operating in the domain www.mokobelle.pl;
Seller - 7Stones spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw at ul. Dominikańska 21B, 02-738 Warsaw entered in the register of entrepreneurs of the National Court Register as number KRS 0000331840, registered in the District Court of the Capital City of Warsaw, XIII Commercial Division of the National Court Register; share capital paid in full at the amount of 20,400.00 PLN (twenty thousand and four hundred zloty), NIP (taxpayer identification number): 521 359 92 36, REGON (National Business Registry Number): 142878397;
Shop Website - means the web pages under which the Seller conducts the Online Shop;
Goods - the products available in the Online Shop, for which an Order can be placed;
Sale agreement (Agreement) - the sales contract for Goods concluded between the Seller and the Customer in the Online Shop;
Consumer Rights Act - the act of 30th May 2014 on consumer rights (Journal of Laws 2014, item 827, as amended);
Personal Data Protection Act - the act of 10th May 2018 on the protection of personal data (Journal of Laws 2018, item 1000);
Act on the Electronic Provision of Services - the act of 18th July 2002 on the provision of services by electronic means (Journal of Laws 2019, item 123);
User - any natural person visiting or registered on the Website using one or more functionalities of the Website.
Order - a disposition to purchase Goods made by the customer in the Online Shop in accordance with the Terms and Conditions.
2. These Terms and Conditions have been issued under article 8 of the Act on the Electronic Provision of Services. These Terms and Conditions do not apply to the sale of Goods made in any other way than through the Online Shop.
3. The Terms and Conditions determine among other things, the terms and conditions for the use of the Online Shop and include in particular the following types and scope of services:
a. the terms for the registration, logging in and use of a Customer Account in the Online Shop;
b. the terms and conditions governing Orders for Goods in the Online Shop;
c. the terms and conditions for concluding a Sales Contract using the services offered by the Online Shop;
d. the principles for conducting a Customer Account by the Seller;
e. the principles for providing the electronic newsletter service.
4. The use of the Online Shop by a Customer requires prior acknowledgment of these Terms and Conditions and consent to be bound by the provisions contained herein (acceptance of the Terms and Conditions).
5. The Seller makes the Online Shop available via the internet and the Shop Website as a resource of an information and communication system.
6. Placing an Order in the Online Shop and use of the services available on the Shop Website requires an active email account with a Customer.
7. Information and content on the Shop Website do not constitute an offer, but merely an invitation to negotiate (bargain) for the conclusion of a contract.
8. The Seller reserves the right to make changes at any time to the Goods and their prices, as well as carry out and cancel any promotions and sales of Goods. These changes may not violate the rights of Customers using the Online Shop.
9. Customers using the Online Shop Website (and the Online Shop) are required to:
a. not deliver illegal content nor use the Online Shop and Online Shop Website in a manner contrary to the law;
b. not violate personal rights nor other rights of third parties;
c. use any information available on the Online Shop Website (including sales, marketing and promotion materials) only for personal use;
d. comply with the laws applicable in the Republic of Poland and adhere to these Terms and Conditions and general principles concerning the functioning of the internet;
e. not undertake illegal activities affecting the good name of the Seller.
10. The provisions of these Terms and Conditions are not intended to exclude nor limit any rights of a Buyer who is also a consumer, which they are entitled to under the applicable laws. In the event of non-compliance of the provisions of these Terms and Conditions with the above provisions, these provisions shall prevail.
11. In case of conflict between the provisions of these Terms and Conditions and the law applicable to the Buyer who is a Consumer from outside the European Union, the provisions generally applicable in Consumer’s country shall apply.
II. Placing and completion of Orders
1. Orders can be placed in the Online Shop seven days a week throughout the calendar year.
2. The Online Shop sells goods in the Republic of Poland and abroad, subject to the provisions of point 2 of paragraph II ("Placing and completion of Orders") of these Terms and Conditions.
3. Customer can place Orders without prior registration or after registration. Registration is not a prerequisite for placing Orders in the Online Shop.
4. Registration allows one to create an individual Customer Account, so the Customer can enjoy a range of additional features that, among other things, allows the Customer to save time when making subsequent Orders. Customer registration occurs through the proper completion and acceptance of the registration form available on the Online Shop Website. Registration is one-time - for each subsequent Order the Customer uses a login (an individual identifier – the email address of the Customer) and password set by them in the registration form. The login and password, which should be no shorter than 6 characters, is confidential data. Updating or modifying the data contained in the registration form can be done by the Customer using the login and password to log on in order to place Orders.
5. During registration, a Customer may consent to the processing of their personal data for marketing purposes and agree to receive the Seller’s marketing and commercial materials electronically - the newsletter, as referred to in section IX of these Terms and Conditions. The provision of the above consents is voluntary.
6. After the Seller has received the completed registration form, the Customer receives an email, at the email address specified in the registration form, confirming registration, which is equivalent to signing a contract for the provision of electronic service to maintain a Customer Account. A contract to maintain an Account in the Online Shop is concluded for an indefinite period of time and does not entail any financial obligation for the Buyer. The contract may be terminated at any time by deleting the Account in the Online Shop or sending notice of resignation by the Buyer to the Seller’s email address: skleponline@mokobelle.pl.
7. To place Orders through the Online Shop, a Customer should go to the Online Shop Website and perform subsequent actions based on the messages and information displayed on the webpage.
8. Placing orders is done by a Customer using the Order Form available by logging into the Customer Account in the Online Shop or using the form allowing for the placement of an Order without registration. The selection of Goods takes place by adding them to the cart containing the Goods included in the Order.
9. For some Mokobelle brand products, one may (and in some cases must), at the stage of completing an Order, use additional options offered by the Online Shop, such as the type and colour of the pendant or hook, the colour of the chain (silver or gold) and thread and determining the size of the product. These functions are shown on the Online Shop Website.
10. Once a Customer has completed all the necessary data specified in the Order form and indicated the delivery methods and forms of payment, an on-screen summary of the Order will appear containing the following data:
a. the ordered Goods;
b. the unit price of the individual Goods and the total price when ordering more than one product;
c. the cost of delivery in the form chosen by the Customer.
11. Placing an Order takes place by clicking on "Order with the obligation to pay."
12. The placing of an Order by a Customer is the submission to the Seller of an offer to conclude a contract for the sale of the Goods covered by the Order with the Seller.
13. After receiving an Order, the Seller sends the Customer a message confirming the acceptance of the Order to the specified email address (“Confirmation'' or "Order Confirmation"). A Goods sales contract is concluded with the receipt of this message by the Customer. The content of this message, providing evidence of the contract of sale for the Goods will include, among other information, the number of the Order submitted by the Customer and the required information referred to in article 12, paragraph 1 of the act on Consumer Rights and information on the Personal Data Controller.
14. The Seller may, after making the appropriate arrangements with the Customer, accept an individual order ("Individual Order") consisting of creating jewellery based on a design prepared jointly with the Customer.
15. Individual orders can be placed via the email address of the Online Shop, by telephone or in one of the Mokobelle boutiques listed in paragraph IV ("Delivery"), point 1 of these Terms and Conditions.
16. The execution time of an Individual Order is up to 14 Business Days from the moment of accepting the design by the Customer, and in the case of elements (materials) necessary for such execution which are difficult to obtain, this time may be extended up to 21 Business Days.
17. The Seller informs the Customer when the Online Shop lacks the ordered Goods or if it is not possible to complete an Order within the period specified herein. The Customer may agree to extend the term of the Order or cancel the ordered Goods or cancel the entire Order.
18. Orders for Goods can be submitted 24 hours a day. In the event that Confirmation is sent to the Customer by the Seller on a business day between the hours of 24:01 and 16:00, it is assumed that Customer placed the Order on the same day. In every other case, it is assumed that the Customer placed the Order on the first Business Day immediately following the Business Day on which the Customer received Confirmation.
19. The Seller reserves the right to refuse confirmation of an Order or resign from the completion of an Order, after prior calling the Customer to remedy the deficiencies or ceasing violations in each of the following cases:
a. an Order form is not completed in full or has been completed in an incorrect manner;
b. an Order was placed in violation of the provisions of the Terms and Conditions.
20. In case of refusal to confirm an Order or cancellation of an Order, the Seller shall inform the Customer to their email address or phone number within 2 Business Days immediately following the day on which it received the Order placed by the Customer. In this case the Seller shall refund the price of the Goods and delivery costs paid by the customer (if these amounts were paid by the Customer).
21. The Seller reserves the right to ownership of the Goods until the receipt of payment of the price by the Customer.
22. Detailed issues, to the extent not regulated by these Terms and Conditions, related to the purchase and execution of gift vouchers in the Online Shop and the return of Goods, for which the payment was made with such vouchers, are defined in the Terms and Conditions of the vouchers available in the Online Shop.
III. Prices, shipping costs and method and terms of payment
1. Prices in the Online Shop are in Polish zloty (they may also be specified in US dollars, euros or British pounds, if the Buyer resides or has their registered office outside the Republic of Poland) and include VAT. Prices do not include delivery costs which are indicated when placing Orders.
2. A product delivered outside the European Union may give rise to an obligation to pay customs duties by the Buyer or a relevant tax in accordance with the rules in force in the country of destination. To check the fees associated with customs clearance and its costs, the Buyer is asked to contact their local Customs Office.
3. The Buyer is informed of the total amount of an Order each time before placing the Order, which is confirmed by pressing the "Order with obligation to pay" button.
4. All orders on Polish territory include the proof of purchase (bill, receipt or VAT invoice).
5. The Customer may choose the following forms of payment for the Goods purchased:
a. payment by ordinary bank transfer or internet transfer to the Seller's bank account at ING Bank Śląski S.A. account number: 25105010251000009080000277, 7stones Sp. z o.o. ulica Dominikańska 21B, 02 Warsaw,
b. payment by payment card - Visa, Visa Electron, MasterCard (via Dotpay),
c. payment by bank transfer via the internet site Dotpay - for Orders with delivery in Poland,
d. payment by transfer via Paypal - for Orders with delivery outside Poland,
e. payment with an electronic gift voucher purchased in the Online Shop,
f. payPo deferred payment (via the Dotpay internet service); Check details,
g. cash on delivery - applies to orders only within Poland.
6. If the Customer chooses the option of delivery to a third party at an address specified by the Customer, payment for the Order must be made before the Goods are dispatched (there is no option for the Buyer to choose cash on delivery).
7. In the case of payment by bank transfer Seller requires the Customer’s name and Order number to be included in the transfer details.
8. In the case of the payment method, referred to in points 7 a), b), c), d) of this section, if the Customer fails to make a payment within 5 days of the Order confirmation, the Seller will call the customer to make a payment. In the event of an ineffective call, the Seller has the right to cancel the Order, informing the Customer by email or telephone of this fact.
9. Internet payments made on-line via the Online Shop www.mokobelle.pl in Poland are supported through the platform Dotpay available at www.dotpay.pl, used by Dotpay S.A. with its registered office in Krakow, at ulica Wielicka 72, 30-552 Krakow, Tax ID: 63426B1860, REGON {statistical identification number}: 240770255, entered in the National Court Register kept by the District Court for Krakow - Śródmieście in Krakow, XI Commercial Division of the National Court Register, as KRS number 0000296790.
10. Internet payments made on-line via the Online Shop www.mokobelle.pl outside Poland are supported by the platform PayPal (Europe) S.a.r.l. et Cie SCA, registered with the RCS Luxembourg as number B 118 349, with its official seat in Luxembourg, L-2449, subject to strict supervision by the Luxembourg supervisory authority, Commission de Surveillance du Secteur Financier (Financial Sector Supervisory Commission).
IV. Delivery
1. In Poland, a Customer can choose the following ways to receive ordered Goods:
a. personal collection at: Mokobelle Boutique, ulica Wilcza 3 (entrance on ulica Mokotowska 54), 00-538 Warsaw or Mokobelle Boutique, Elektrownia Powiśle, unit No. 121, 1st floor, ulica Dobra 24, 00-312 Warsaw, depending on which of these places of collection the Customer chose when placing the Order.
b. delivery to the address the Customer provided when placing the Order by DHL courier, InPost courier or collection from the selected DHL Parcel Shop point.
c. delivery of the Goods to an InPost collection point chosen by the Customer when placing the Order.
2. Delivery outside Poland takes place via DHL and UPS couriers to the address specified in the Order, with the reservation that the Seller does not deliver Goods to addresses in Germany or the United Kingdom.
3. Time of delivery outside Poland depends on the country of delivery. To check the approximate time of delivery, the Customer is asked to contact us by email at: skleponline@mokobelle.pl.
4. The delivery method is chosen by the Customer when placing an Order.
5. Delivery costs shall be borne by the Customer. In the case of personal collection from the Mokobelle Boutiques indicated in point 1 a) of this section, the Customer shall incur no delivery costs.
6. The Customer is informed about the delivery costs when placing an Order. In the case of shipment outside the Republic of Poland, the shipping cost is calculated individually based on the estimated weight of the package and the country of destination.
7. The Seller undertakes to provide the Customer with products free of defects.
8. The Customer undertakes to receive the shipped Product.
9. The delivery of Goods in Poland will be carried out by the Seller within 3 to 5 Business Days following the day on which the payment made by the Customer was credited to the Seller's bank account, payment was made by a gift voucher in electronic form or an order was placed with payment on delivery (cash on delivery). The above provisions do not apply to the cases specified in point 10 of this section.
10. Due to the fact that all Mokobelle Goods are handmade, it may happen in exceptional cases (in particular with respect to Goods included in certain collections offered by the Seller, Orders placed before Easter or Christmas, as well as Orders submitted during promotional or discount campaigns organised by the Seller) that an Order delivery term may be extended. In this case, the Customer will be sent (within 3 Business Days of the Seller receiving the Order submitted by the Customer) a message to the specified email address, in which the Customer will be notified of the new Order completion term. In this case, the Customer will have the right to cancel the Order by notifying the Seller of this fact in an email sent to: skleponline@mokobelle.pl. The Seller will refund the price paid by the Customer for the Goods and delivery costs (if these amounts were paid by the customer) within 2 Business Days following the date on which the Seller receives the Order cancellation from the Customer.
11. With the delivery, the Customer receives a relevant document constituting proof of purchase/conclusion of the transaction (receipt, VAT invoice).
V. The rights regarding withdrawal from the Sales Agreement
1. A Customer, who is a Consumer domiciled in the European Union, has the right to withdraw from a distance contract, without stating the reason, within 14 days of the date of receipt of the Goods.
2. A Customer residing outside the European Union shall have the right to withdraw from a distance contract, without stating the reason, within 30 days of the date of receiving the Goods.
3. A Customer shall not be entitled to the above right in the following cases:
a. the provision of services if the Seller provided a service in full with the express consent of the Customer, who had been informed before the provision that after the provision of service by the Seller the Customer will lose the right to withdraw from the agreement,
b. contracts for services, for which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the deadline to withdraw from the contract,
c. agreements whose object is a non-prefabricated item, manufactured according to the Customer's specifications or tailored to their individual needs,
d. agreements whose object is a perishable item or an item with short shelf life,
e. agreements whose object is an item delivered in a sealed container, which after opening the package cannot be returned due to protection of health or hygiene reasons, if after delivery the package has been opened by the Customer,
f. special agreements concerning items that after delivery, due to their nature, are inextricably linked with other items,
g. agreements whose object is alcoholic beverages, for which the price has been agreed at the conclusion of the sales agreement and delivery can only take place after 30 days, and their value depends on fluctuations in the market, over which the Seller has no control,
h. agreements, in which the Customer explicitly demanded that the Seller travels to them to make urgent repairs or maintenance. If the Seller provides 13. The provisions of this section shall not apply to Customers who are not consumers - in their case the right to withdraw from the Sales Contract is absolutely excluded.
VI. Complaints about the Goods
1. The Seller is liable to the Customer, who is a Consumer, for non-compliance with the contract for the Goods purchased.
2. The Seller undertakes to provide the Customer with products free of defects. In the event of defects in the Goods, the Customer may request the repair of the Goods, replacement with Goods free of defects, a reduction in the price of the Goods or withdrawal from the contract of sale.
3. If it is determined that the Product has a defect, the Buyer is obliged to notify the Seller.
4. A complaint should contain the Buyer’s details, a description of the defect in the Goods, the date of its occurrence and the Buyer's request. In order to facilitate the complaint procedure the Seller provides Appendix 2 on the Online Shop Website. Use of the template is not obligatory and is left at the Customer's discretion.
5. The Buyer is obliged to return the Goods included in the complaint.
6. Complaints should be addressed to:
Mokobelle Boutique, ulica Wilcza 3, 00-538 Warsaw or by email by sending a message to the email address: skleponline@mokobelle.pl.
7. If data or information given in the complaint need to be supplemented, before dealing with the complaint the Seller shall ask the party lodging the complaint to supplement it in the indicated scope.
8. The Seller shall consider the complaint within 14 days of the date of its submission by the Customer. No response from the Seller by the expiry of the term indicated in the previous sentence results in recognition of the complaint as justified.
9. The Seller shall be liable under the warranty if the defect has been detected within 2 years of the date of the Product's release to the Customer.
VII. Complaints concerning the provision of electronic services
1. Any irregularities in the operation of the Online Shop, including interruptions in the functioning of the Online Shop Website, may be reported by the Customer to the following address: Mokobelle Boutique, ulica Wilcza 3, 00-538 Warsaw, or by email to the address: skleponline@mokobelle.pl.
2. A complaint must contain in particular its subject (including the kind of irregularity in the functioning of the Online Shop), the date of the irregularity, the name and address of the Customer submitting the complaint and their postal address.
3. The Seller shall consider the complaint within 14 days of the date of its submission by the Customer.
additional services other than those which the Customer demanded or provides items other than replacement parts necessary for repair or maintenance - the right of withdrawal is granted to the Customer for the additional services or items,
i. agreements whose object is sound or visual recordings or computer software delivered in a sealed package if after delivery the package has been opened by the Customer,
j. delivery of newspapers, periodicals or magazines, with the exception of subscription contracts,
k. agreements concluded by public auction,
l. contracts for the provision of accommodation other than for residential purpose, carriage of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the date or period for the provision of the service,
m. contracts for the supply of digital content, unsaved on a tangible medium if the performance has begun with the express consent of the Customer before the deadline to withdraw from the contract and after being informed by the Seller about the loss of the right of withdrawal.
4. For the effective withdrawal referred to in paragraphs 1 and 2 of this section it is sufficient to submit a statement by the Customer via email or post. In order to facilitate the withdrawal the Seller provides on the Online Shop Website a template for the statement – Appendix 1. Use of the template is not obligatory and left to the Customer's discretion.
5. A Customer shall not be entitled to withdraw from a contract relating to an Individual Order.
6. A Customer withdrawing from the contract is obliged to return the Goods within 14 days of the date of withdrawal, except for Customers from outside the European Union, for whom this period is 30 days.
7. The shipping costs of returned Goods shall be borne by the Customer.
8. A Customer is liable for a reduction in the value of the Goods as a result of their use beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
9. The Seller guarantees the refund of the price of the Goods and the costs of shipping the Goods to the Customer immediately, and no later than within 14 days of the date on which it received the Customer's statement of withdrawal from the contract.
10. The Seller shall refund payment using the same method of payment, which the Customer used unless the Customer has explicitly consented to another method of refund, which is not related to any additional costs.
11. If the Customer has chosen a different delivery method other that the cheapest normal delivery offered by the Seller, the Seller is not obliged to refund the Customer the additional costs incurred by them.
12. Returns of Goods on the withdrawal from the contract, sent at the expense of the Seller or COD will not be accepted.
VIII. The Seller’s liability
1. The Seller shall be fully liable for non-performance or improper performance of the contract, provided that in the case of agreements with Customers with the status of Entrepreneurs, the Seller will be liable only in case of intent to cause damage and to the amount of losses actually borne by the Customer.
IX. Newsletter
1. Each Customer can use the free newsletter service provided electronically ("newsletter").
2. The newsletter service consists of the Seller sending to the email address provided by the Customer materials in electronic form, including information on available Goods and services offered by the Seller, planned promotions and events related to the activities of the Seller.
3. In order to receive the newsletter, the Customer may agree to receive it during registration on the Website or at any other time. This consent is given when creating a Customer Account or independently of online registration. The above consent is given voluntarily by the Customer.
4. After the Seller receives the Customer's consent to receive the newsletter, the Seller sends confirmation of the Customer's acceptance to receive the newsletter to the email address provided by the Customer.
X. Processing of a Customer’s personal information
1. The personal data of users of the Website, including Customers, are collected and processed by the Seller to the extent necessary for the execution of the Order and distribution of current information related to the Online Store in accordance with the act of 10th May 2018 on personal data protection (Journal of Laws of 2018, item 1000) and the Regulation of the European Parliament and of the Council (EU) 2016/679 of 25th May 2018 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).
2. Personal data received from visitors to the Website and the registered users are processed and used only for such purposes, and to the extent to which these persons consent. Information about the purposes and scope of data processing is provided in the Information Clause. Personal data of Website users are not in any case sold or provided to third parties. Consent to the processing of personal data for marketing purposes is voluntary.
3. Collected personal data of users of the Website are treated as a database, stored on a secure server in a special security zone, ensuring adequate protection. Only authorised administrators have full access to the database. In addition, protection of personal data during transmission is ensured by the appropriate security protocol (SSL). Moreover, as the Personal Data Controller for the data collected by the Website, we may by agreement entrust the processing of the data to other entities pursuant to article 28 of GDPR. Databases of users are registered in the office of the Inspector General for Personal Data Protection: GIODO register book No.: 104977 and 104975 (currently the Office for Personal Data Protection).
4. In processing personal data, the Seller pays special attention to the data being protected against their unauthorised disclosure. The exercise of the right to demand access to personal data, correct them, discontinue their processing and demand their removal from the system of the Website is carried out by sending to the personal data controller - the Seller, a relevant request by email to: ochronadanych@mokobelle.pl together with the forename and surname of the Website user submitting such a demand.

The Company is registered with the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, KRS No. 0000381840, NIP {taxpayer identification number} 5213599236, REGON {statistical identification number} 142878379. The personal data provided by you will be processed for the following purposes:
a) performance of a sales contract for goods offered on the website www.mokobelle.com - on the basis of article 6, section 1, point b) of GDPR - processing is necessary to perform the contract, until the end of the contract. The provision of personal data is voluntary. Failure to provide personal data when placing an order will result in the impossibility of its implementation, including the performance of obligations assumed by 7stones Sp. z o.o. under contracts concluded with you.
b) direct marketing - on the basis of article 6, section 1, point f) of GDPR - the legitimate interest of 7stones Sp. z o.o., until the termination of the contract or filing an objection;
c) financial - accounting - on the basis of article 6, section 1, point c) of GDPR - processing is necessary for the execution of legal regulations, e.g. tax regulations, including article 74 of the Accounting Act, for the period required by the relevant tax regulations;
d) defence against and enforcement of claims - on the basis of article 6, section 1, point f) of GDPR - the legitimate interest of 7stones Sp. z o.o., until the expiry of the claims period under the Civil Code;
e) conducting complaint processes - on the basis of article 6, section 1, point f) of GDPR - legitimate interest of 7stones Sp. z o.o., for a period of 3 years from the end of the contract;
f) for analytical and statistical purposes - on the basis of article 6, section 1, point f) of GDPR - a legitimate interest of the Personal Data Controller, in connection with conducting analyses of Users' activities and their preferences in order to improve the applied functionalities and provided services.
In connection with the purposes referred to above, the recipients of your personal data may be entities intermediating in the performance of contractual obligations by the controller, e.g. IT service providers, accountants, on-line payment providers.
You have the right to access your data and the right to rectify, erase, restrict processing, the right to data portability, the right to object (e.g. if your data are processed on the basis of your consent, or for marketing or data sharing purposes); you have the right to withdraw your consent at any time. XI. Copyright protection
1. All photos of Goods and other materials (including text, graphics, and logos) published on the Online Shop www.mokobelle.com Website are owned by the Seller or have been used by it with the consent of third parties holding copyrights.
2. It is prohibited to copy pictures and other graphic materials and use reprinting of texts posted on the Online Shop www.mokobelle.com Website, including making them available on the internet without the written consent of the Seller or any other third party holding the copyrights.
3. Outside parties are also prohibited from downloading images from the Online Shop www.mokobelle.com Website and use them for marketing and commercial purposes.
4. The use of the above materials without the written consent of the Seller or any other third party holding copyright is illegal and may give rise to initiating civil and criminal proceedings against the perpetrators of this practice.
XII. Technical requirements necessary to work with the ICT system
1. Subject to the provisions set out below in paragraphs 2 and 3, the Seller will endeavour to make using the Online Shop and other services available on the Online Shop Website possible with all popular web browsers and operating systems.
2. Correct use of the Online Shop requires (the minimum technical requirements enabling use of the Online Shop Website):
a. access to the internet;
b. use of a web browser at least Microsoft Internet Explorer 8, Google Chrome 16, Mozilla Firefox 10, Opera 11 or later versions;
c. have an internet connection with a bandwidth of at least 256 Kbit/s;
d. an email account in order to receive emails.
XIII. Transitional and final provisions
1. The Terms and Conditions shall be valid from the date of publication on the Online Shop Website and replace the previously applicable terms and conditions of the Online Shop, provided that the provisions set out below in paragraphs 6 to 8 shall apply accordingly.
2. In matters not regulated by these Terms and Conditions, the relevant provisions of law shall apply.
3. The appendices mentioned in the text of the Terms and Conditions are an integral part thereof.
4. The Seller reserves the right to amend these Terms and Conditions, in particular in the case of changes in the law (including changes in their interpretation) or to improve the functioning of the Online Shop and improve the protection of the privacy of users of the Website (Customers of the Online Shop) and prevent fraud. Amendments shall enter into force at the moment clearly indicated by the Seller. Amendments to the Terms and Conditions may not violate the acquired rights of Customers who use the Online Shop.
5. Amendments to the Terms and Conditions shall be delivered to Customers by placing information about the amendments to the Terms and Conditions on the homepage of the Online Shop and in another manner, chosen by the Seller, ensuring that Customers are aware of these amendments. The above information shall be displayed on the Home Page of the Online Shop for a period of no less than 14 Business Days. In addition, Customers who have registered with the Online Store will be notified of a change to the Terms and Conditions when they first log in to the Online Shop from the time the new Terms and Conditions take effect.
6. The contents of these Terms and Conditions may be recorded by printing, saving to a medium or downloading from the Website of the Online Shop.
7. If a registered Customer (holding a Customer Account) does not accept the new contents of the Terms and Conditions, they shall notify the Seller of this fact within 14 Business Days of the date of learning about the changes in the Terms and Conditions. Refusal to accept the amendments to the Terms and Conditions shall result in the termination of the contract for the provision of services by electronic means, subject to the parties to the contract keeping the rights acquired before the said termination.
8. Amendments to the Terms and Conditions will not apply to Orders placed prior to the displaying of the amendments on the Online Shop Website. These Orders will be executed on the basis of the Terms and Conditions in force on the date of placing the Order.
9. In the event of any conflicts between the provisions of the Terms and Conditions and the provisions of law in force, such provisions shall replace the provisions of the Terms and Conditions affected by invalidity. In such a case, the remaining provisions of the Terms and Conditions shall remain in force.
10. The Terms and Conditions do not limit the rights of Consumers under applicable law, which provisions cannot be excluded or modified by agreement between the parties.
