TERMS AND CONDITIONS OF THE ONLINE SHOP WWW.MOKOBELLE.PL

The Terms and Conditions define the conditions of sale of the online shop operating in the domain www.mokobelle.pl by 7Stones sp. z o.o. with its seat in Warsaw and define the principles and conditions of provision of unpaid services electronically by 7Stones sp. z o.o. with its seat in Warsaw.

I. General Provisions

1. Definitions:

Delivery time - the time in which the Seller completes the order and forwards it to the Supplier executing the form of delivery selected by the Customer,

Business Days - the days of the week from Monday to Friday, excluding public holidays under the applicable law;

Supplier - entrepreneur (courier company specializing in supplying shipments) selected by the Seller for delivery of goods to customers;

Proof of purchase / proof of transaction - a receipt, invoice or other proof of purchase of the Goods;

Customer - a natural person with full legal capacity, and in the cases provided for by the generally applicable provisions also a natural person with limited legal capacity, a natural person running a business, legal person or organizational unit without legal personality, making orders in the Online Shop;

Consumer - a physical person making the legal action not directly related to its business or professional activity;

Customer Account - a personalized account created for the Customer following their registration on the Online Shop Website;

Newsletter - a service provided electronically by the Seller, which provides the interested buyers with automatically important information relating to the Online Shop received via e-mail.

Entrepreneur - natural person, legal person or organizational unit without legal personality running business in its own name;

Terms and Conditions - the present Terms and Conditions of providing services electronically via the Online Shop operating at www mokobelle.pl,

Website - means web pages, under which the Seller runs the Online Shop;

Online Shop (Shop) - online shop operating in the domain www.mokobelle.pl;

Seller - 7Stones spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw at ul. Dominikańska 21B, 02-738 Warsaw entered in the register of the National Court Register KRS 0000331840, registered in the District Court of the Capital City of Warsaw, XIII Commercial Division of the National Court Register; share capital paid in full in the amount of PLN 20,400.00 (twenty thousand four hundred zlotys), Tax ID: 521 359 92 36, REGON: 142878397;

Shop Website - means websites under which the Seller runs the Online Shop;

Goods - product available in the Online Shop, for which an Order can be placed;

Sale agreement (Agreement) - Goods sales contract concluded between the Seller and the Customer in the Online Shop;

Consumer Rights Act - Act of 30 May 2014 on consumer rights (Journal of Laws 2014 item 827);

Personal Data Protection Act - Act of 29 August 1997 on protection of personal data (Journal of Laws 2014, item 1182, as amended);

Act on Electronic Provision of Services - the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws No. 144, item 1204)

Order - disposition to purchase the Goods made by the customer in the Online Shop in accordance with the Terms and Conditions.

2. Terms and Conditions have been issued under article 8 of the Act on Electronic Provision of Services. It does not apply to the sale of Goods made in any other way than through the Online Shop.

3. Terms and Conditions determine among other things, the terms and conditions for the use of the Online Shop and include in particular the following types and scope of services:

a. terms for the registration and use of Customer Account in the Online Shop;

b. terms and conditions governing the Orders of Goods in the Online Shop;

c. terms and conditions of contract for the sale with the services offered by the Online Shop;

d. principles of running a Customer Account by the Seller;

e. principles of newsletter service by electronic means,

4. Using the Online Shop by a Customer requires prior acknowledgment of these Terms and Conditions and consent to be bound by provisions contained herein (acceptance of the Terms and Conditions)

5. Seller makes available the Online Shop via the Internet and Shop Website as a resource of the information and communication system.

6. Placing an Order in the Online Shop and use of the services available on the Shop Website requires an active e-mail account.

7. Information and content on the Shop Website do not constitute an offer, but merely an invitation to negotiate (bargain) for the conclusion of the contract.

8. The Seller reserves the right to make changes at any time to the Goods and their prices, as well as carry out and cancel all kinds of promotions and sales on Goods. The changes may not violate the rights of the Customers, who use the Online Shop.

9. Customer using the Online Shop Website (and the Online Shop ) is required to:

a. not deliver illegal content and not use the Online Shop and Online Shop Website in a manner contrary to the law;

b. not violate personal rights and other rights of third parties;

c. use any information available on the Online Shop Website {including sales, marketing and promotion materials) only for personal use;

d. comply with laws applicable in the territory of the Polish Republic and adhere to these regulations and general principles concerning the functioning of the Internet:

e. not undertake illegal activities affecting the good name of the Seller.

10. Provisions hereof are not intended to exclude or limit any rights of the Buyer who is also a consumer, which they are entitled to under the applicable laws. In case of non-compliance of the provisions hereof with the above provisions, these provisions shall prevail.

11. In case of conflict between the provisions hereof and the law applicable to the Buyer who is a Consumer outside the European Union, the provisions generally applicable in Consumer’s country shall apply.

II. Placing and completion of Orders

1. Placing Orders in the Online Shop is possible seven days a week, every day of the calendar year.

2. The Online Shop sells goods in the territory and outside the Polish Republic.

3. Customer can place Orders without prior registration and after registration. Registration is not a prerequisite for placing Orders in the Online Shop.

4. Registration allows one to create an individual Customer Account, so customer can enjoy a range of additional features that allow, among other things, to save time when making subsequent Orders. Customer registration occurs through the proper completion and acceptance of the registration form available on the Online Shop Website. Registration is one-time - for each subsequent Order Customer uses a login (individual identifier – e-mail address of the Customer) and password set by them in the registration form. Login and password, which should be not less than 6 characters, is confidential data. Updating or modifying the data contained in the registration form can be made ​​by the Customer using the login and password to log on in order to place orders.

5. During registration, Customer may consent to the processing of personal data for marketing purposes and agree to receive Seller’s materials electronically - newsletter, referred to in section IX hereof. Providing these consents is voluntary.

6. After receiving by the Seller of the completed registration form, Customer receives, in electronic form to the e-mail address specified in the registration form, information on the confirmation of registration, which is equivalent to signing with the contract for the provision of electronic service of maintaining Customer Account. The agreement on maintaining the Account in the Online Shop is concluded for an indefinite period of time and does not entail any financial obligation for the Buyer. The agreement may be terminated at any time by deleting the Account in the Online Shop or sending information about resignation by the Buyer to the Seller’s e-mail address: onlineshop@mokobelle.pl.

7. To place orders through the Online Shop, Customer should go to the Online Shop Website and perform subsequent actions based on the messages and information displayed.

8. Placing orders is done using the Order Form available by logging to the Customer Account in the Online Shop or using a form allowing placing an Order without registration. Selection of Goods takes place by adding them to the cart (clicking “Add to cart”).

9. For some Mokobelle brand products, one may (and in some cases must) use at the stage of completing an Orders additional options offered by the Online Shop, such as the choice of stone, choice of the type and colour of the tag, choice of chain and thread colour and determining the size of the product. These functions are shown at the Online Shop Website.

10. Once Customer has completed all the necessary data specified in the Order form and indicated delivery methods and forms of payment, on-screen summary of the Order will appear containing the following data:

a. ordered Goods;

b. unit price of individual Goods (by net price, VAT and gross price) and the total price when ordering more than one product;

c. cost of delivery in the form chosen by Customer.

11. Placing an Order takes place by clicking on "Order with the obligation to pay."

12. Placing an Order is the submission to the Seller an offer to conclude an agreement for the sale of Goods covered by the Order with the Seller.

13. After receiving an Order, the Seller sends the Customer to the specified e-mail address a message confirming the acceptance of the Order (“Confirmation'' or "Order Confirmation"). Goods sales contract is concluded with the receipt of the message by the Customer. The content of this message, providing evidence of the contract of sale of the Goods will include the Order number and the required information referred to in Article 12.1 of the Consumer Rights Act.

14. Seller informs Customer when the Online Shop lacks the ordered Goods or if it is not possible to complete an Order within the period specified herein. Customer may agree to extend the term of the Order or to give up ordered Product or all of the Order.

15. Orders for Goods can be submitted throughout the day. In case the Confirmation is sent to the Customer by the Seller on the working day between the hours of 24:01 and 16:00, it is assumed that Customer placed the Order on the same day. In any other case, it is assumed that Customer placed the Order on the first Business Day immediately following the Business Day on which the Customer received Confirmation.

16. The Seller reserves the right to refuse confirmation of an Order or resign from the completion of an Order, after prior calling the Customer to remedy the deficiencies or ceasing violations in each of the following cases:

a. an Order form is not completed in full or has been completed in an incorrect manner;

b. an Order was placed in violation of the provisions of the Terms and Conditions.

17. In case of refusal to confirm an Order or cancellation of an Order, the Seller shall inform the Customer to their e-mail address or phone number within 2 Business Days immediately following the day on which it received the Order placed by the Customer. In this case the Seller shall return the price of the Goods and delivery costs paid by the customer (if these amounts were paid by the Customer).

18. The Seller reserves the right to ownership of the Goods until the receipt of payment of the price by the Customer.

III. Prices, shipping costs and method and terms of payment

1. Prices in the Online Shop are in Polish zloty, US dollars, euros or British pounds and include VAT. Prices do not include delivery costs which are indicated when placing Orders.

2. A product delivered outside the European Union may give rise to an obligation to pay customs duties by the Buyer or a relevant tax in accordance with the rules in force in the country of destination. To check the fees associated with customs clearance and its costs, the Buyer is asked to contact their local Customs Office.

3. The Buyer is informed of the total amount of an Order each time before placing the Order.

4. All orders on Polish territory include the proof of purchase (bill, receipt or invoice).

5. All orders beyond the Polish borders are accompanied by an invoice.

6. The Customer can choose the following forms of payment for purchased Goods:

a. normal or online transfer payment to the Seller’s bank account ING Bank Slaski SA number 25105010251000009080000277,  7Stones Sp. z o.o. ul. Dominikańska 21B, 02-738 Warsaw - for orders delivered in Poland; ING Bank Slaski SA number IBAN PL25105010251000009080000277, number SWIFT: INGBPLPW, 7Stones Sp. z o.o., ul. Dominikańska 21B, 02-738 Warsaw - for orders with delivery outside the Polish borders;

b. payment by credit card - Visa, Visa Electron, MasterCard;

c. online payment - Dotpay - for orders delivered in Poland;

d. online payment - PayPal - for orders with delivery outside the Polish borders;

e. cash on delivery – applies exclusively to orders on Polish territory.

7. In case of payment by bank transfer Seller asks for placing on the transfer order the Customer’s name and Order number.

8. In case of payment method, referred to in points 6 a), b), c), d) of this section, if the Customer fails to make a payment e within 7 days of the Order confirmation, the Seller will call the customer to make a payment. In case of ineffective call, Seller has the right to cancel the Order, informing the Customer by mail or telephone.

9. Internet payments made on-line via the Online Shop www.mokobelle.pl in Poland are supported through the platform Dotpay available at www.dotpay.pl, used by Dotpay S.A. with its registered office in Krakow, ul. Wielicka 72, 30-552 Krakow, Tax ID: 63426B18G0, REGON: 240770255, entered into the National Court Register kept by the District Court for Krakow - Śródmieście in Krakow, XI Commercial Division of the National Court Register, under KRS number 0000296790.

10. Internet payments made ​​on-line via the Online Shop www.mokobelle.pl beyond the Polish borders are supported by the platform PayPal (Europe) S.a.r.l. et Cie SCA, registered with the RCS Luxembourg under number B 118 349, with its official seat in Luxembourg, L-2449, subject to strict supervision by the Luxembourg supervisory authority, Commission de Surveillance du Secteur Financier (Financial Sector Supervisory Commission).

IV. Delivery

1. In Poland, Customer can choose the following ways to receive ordered Goods:

a. personal collection at: Mokobelle Boutique, Wilcza street 3 (the entrance on Mokotowska Street 54), 00-538 Warsaw or Mokobelle Boutique, Galeria Mokotów, first floor, unit No. B 1614, Wołoska street 12, 02-675 Warsaw.

b. delivery to the address the Customer provided when placing Order by courier DHL or reception at the selected DHL Parcel Shop point.

2. Delivery outside Poland takes place via DHL and UPS couriers.

3. Time of delivery beyond the Polish borders depends on the country of delivery. To check the approximate time of delivery, Customer is asked to contact us at: onlineshop@mokobelle.pl.

4. The method of delivery is selected by Customer when placing an Order.

5. Delivery costs shall be borne by Customer.

6. Seller agrees to pay shipping costs on Polish territory, if the value of an order exceeds PLN 400.

7. Shipping costs are calculated according to the current price lists and depend on the weight and size of the consignment. Customer is informed about the shipping cost when placing an Order. In case of shipment out of the country shipping cost is calculated individually based on the estimated weight of the package and the country of destination.

8. Seller agrees to provide Customer with products free of defects.

9. Customer agrees to receive the shipped Product.

10. Deliveries on Polish territory will be carried out by the Seller within 7 Business Days following the date on which the payment made ​​by Customer's to the Seller’s bank account was recognized. If Customer has chosen cash payment (cash on delivery), the delivery of the Goods shall be made within 7 Business Days following the date on which the Seller made Order confirmation.

11. In the absence of Customer at the time of delivery Supplier shall leave advice note. The supplier can determine a different date of delivery with the Customer by phone.

12. Due to the fact that all Mokobelle Goods are handmade, it may happen in exceptional cases that the Order delivery term may be extended. In this case, Customer will be sent (on the Business Day immediately following the date of receipt by the Seller of the Order placed by the Customer) to the specified e-mail address information, in which Customer will be notified of the new Order completion term. In this case, Customer will have the right to cancel the Order by notifying the Seller to the e-mail address onlineshop@mokobelle.pl. Seller will refund the price paid by the Customer for the Goods and delivery costs (if these amounts were paid by the customer) within 2 Business Days following the date on which the Seller receives the Order cancellation from Customer.

13. With the delivery, Customer receives a relevant document forming proof of purchase/ transaction (receipt, invoice).

14. Upon receipt of the shipment, Customer can check if the contents are consistent with the Order and that the product is not damaged. In the event of such circumstances Customer may refuse to accept the shipment and notify as soon as possible the Seller using the phone number listed on the Shop Website or e-mail address onlineshop@mokobelle.pl. Failure to check the shipment and refusal to accept the shipment does not withhold any complaints, although in the case of any such verification procedures for handling complaints will be much improved.

V. The rights regarding withdrawal from the Sales Agreement

1. Customer, who is a consumer domiciled in the European Union, has the right to withdraw from a distance contract, without giving any reason, within 14 days from the date of receipt of the Goods.

2. Customer, who is a consumer domiciled outside the European Union, has the right to withdraw from a distance contract, without giving any reason, within 30 days from the date of receipt of the Goods.

3. Customer shall not be entitled to the above right in the following cases:

a. provision of services if the Seller provided a service in full with the express consent of the Customer, who had been informed before the provision that after the provision of service by the Seller the Customer will lose the right to withdraw from the contract,

b. contracts for services, for which the price or remuneration depends on fluctuations in the financial market over which Seller has no control, and which may occur before the deadline to withdraw,

c. agreements whose object is a non-prefabricated item, manufactured according to Customer specifications or tailored to their individual needs.

d. agreements whose object is a perishable item or an item with short shelf life,

e. agreements whose object is an item delivered in a sealed container, which after opening the package cannot be returned due to protection of health or hygiene reasons, if after delivery package has been opened by Customer,

f. special agreements concerning items that after delivery, due to their nature, are inextricably linked with other items,

g. agreements whose object is alcoholic beverages, for which the price has been agreed at the conclusion of the sales agreement and delivery can only take place after 30 days, and their value depends on fluctuations in the market, over which Seller has no control,

h. agreements, in which Customer explicitly demanded that the Seller arrive to them to make urgent repairs or maintenance. If the Seller provides additional services other than those which Customer demanded or provides items other than replacement parts necessary for repair or maintenance - right of withdrawal is granted to Customer for the additional services or items,

i. agreements whose object is sound or visual recordings or computer software delivered in a sealed package if after delivery package has been opened by Customer,

j. delivery of newspapers, periodicals or magazines, with the exception of subscription contracts,

k. agreements concluded by public auction,

l. agreements for provision of accommodation other than for residential purpose, the carriage of goods, car rental, catering, services related to leisure, sports, cultural or entertainment events, if the agreement marked a day or period of service.

m. contracts for supply of digital content, unsaved on a tangible medium if the performance has begun with the express consent of Customer before the deadline to withdraw from the contract and after being informed by the Seller about the loss of the right of withdrawal.

4. For the effective withdrawal referred to in paragraphs 1 and 2 of this article, it is sufficient to submit a statement by Customer via e-mail or post. In order to facilitate the withdrawal Seller provides on the Online Shop Website the template of the statement – Appendix 1. Using the template is not obligatory and left the Customer discretion.

5. Customer withdrawing from the contract, is obliged to return the Goods, together with proof of purchase or a copy within 14 days from the date of withdrawal.

6. Shipping costs of returned Goods shall be borne by Customer.

7. Customer is liable for a reduction in the value of the Goods as a result of its use beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

8. Seller guarantees the refund of the price of the Goods and the costs of shipping goods to Customer immediately, not later than within 14 days,

9. Seller shall refund payment using the same method of payment, which Customer used unless Customer explicitly consented to its return otherwise, which is not related to any additional costs.

10. If Customer has chosen other that the cheapest normal delivery offered by the Seller, the Seller is not obliged to refund Customer additional costs incurred by them.

11. Returns of Goods at the withdrawal from the contract, sent at the expense of the Seller or COD will not be accepted.

12. The provisions of this paragraph shall not apply to customers who are not consumers - in their case the right to withdraw is absolutely excluded.



VI. Complaints about the Goods

1. Seller is liable to Customer, who is a consumer for non-compliance with the agreement of the Goods purchased.

2 Seller agrees to provide the Customer with Goods free from defects. In the case of defects of the Goods, Customer may request the repair of the Goods, replacement with Goods free of defects, reduction in the price of the Goods or withdraw from the contract of sale.

3. If it is determined that the Product has a defect, the Buyer is obliged to notify the Seller.

4. A complaint should contain the Buyer’s details, Product defect description, date of its occurrence and Buyer's request. In order to facilitate the complaint procedure Seller provides Appendix 2 on the Online Shop Website. Using the template is not obligatory and left the Customer discretion.

5. The product complained against should be accompanied by proof of purchase or a copy.

6. Buyer is obliged to return the Product complained against.

7. Complaints should be addressed to:

Boutique Mokobelle, , 04-175 Warsaw or by e-mail by sending a message to the e-mail address: onlineshop@mokobelle.pl.

8. If data or information given in the complaint need to be supplemented, before dealing with the complaint Seller shall ask the party lodging the complaint to supplement it in the indicated scope.

9. Seller shall consider the complaint within 14 days from the date of submission by Customer> No response from Seller on the expiry of the term indicated in the previous sentence results in recognition of the complaint as justified.

10. Seller shall be liable under the warranty if the defect has been detected within 2 years from the date of the Product release to Customer.

VII. Complaints concerning the provision of electronic services

1. Any irregularities in the operation of an Online Shop, including interruptions in the functioning of the Online Shop Website, may be reported to the following address: Mokobelle Boutique, Wilcza street 3 (the entrance on Mokotowska Street 54), 00-538 Warsaw, or by e-mail to the address onlineshop@mokobelle.pl.

2. A complaint must contain in particular its subject (including a kind of irregularity in the functioning of Online Shop), date of irregularity, name and address of Customer submitting the complaint and their mailing address,

3. Seller shall consider the complaint within 14 days from the date of submission by Customer.

VIII. Seller’s liability

1. Seller shall be fully liable for non-performance or improper performance of the contract, provided that in the case of agreements with Customers with the status of entrepreneurs, Seller will be liable only in case of intent to cause damage and to the amount of losses actually borne by Customer.

IX. Newsletter

1. Each Customer can use the free newsletter service provided electronically ("newsletter").

2. The newsletter service consists of sending by Seller to the email address provided by Customer materials in electronic form, including information on available Goods and services offered by Seller, planned promotions and events related to the activities of the Seller.

3. In order to receive the newsletter, during registration Customer can agree to receive it. This consent is expressed during setting up Customer Account or regardless of registration. The above consent is voluntary.

4. After receiving Customer's consent to receive the newsletter, Seller sends confirmation of accepting Customer to the group of newsletter recipients to the email address specified by Customer.

X. Processing of Customer’s personal information

1. Website users' personal data, including customers, are collected and processed by Seller to the extent necessary to carry out orders and distribute current information related to the Online Shop pursuant to the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 2014, item 1182, as amended).

2. Personal data received from visitors to the website and the registered users are processed and used only for such purposes, and to the extent to which these persons consent. Personal data of Website users are not in any case sold or provided to third parties. Consent to the processing of personal data for marketing purposes is voluntary.

3. Collected personal data of users of the Website are treated as a database, stored on a secure server in a special security zone, ensuring adequate protection. Only authorised administrators have full access to the database. In addition, protection of personal data during transmission is ensured by the appropriate security protocol (SSL). Moreover, as the administrator of personal data collected by the Website, we may by agreement entrust the processing of the data to other entities pursuant to Art. 31 of the Data Protection Act of 29 August 1997. Databases of users are registered in the office of the Inspector General for Personal Data Protection: GIODO register book No.: 104977 and 104975.

4. In processing personal data, Seller pays special attention to the data being protected against their unauthorized disclosure. The exercise of the right to demand access to personal data, correct them, discontinue their processing and demand their removal from the system of the Website is carried out by sending to the personal data administrator - Seller, a relevant request by e-mail to: onlineshop@mokobelle.pl together with the name of the Website user submitting such a demand,

5. Detailed information on the protection of Customers’ personal data are included in the Online Shop www.mokobelle.pl Privacy Policy document.

XI. Copyright protection

1. All photos of Goods and other materials (including text, graphics, logos) published on the Online Shop www.mokobelle.p Website are owned by Seller or have been used by it with the consent of third parties holding copyrights,

2. It is prohibited to copy pictures and other graphic materials and use reprinting of texts posted on the Online Shop www.mokobelle.pl Website, including making them available on the Internet without the written consent of Seller or any other third party holding the copyrights.

3. Outside parties are also prohibited from downloading images from the Online Shop www.mokobelle.pl Website and use them for marketing and commercial purposes.

4. The use of the above materials without the written consent of Seller or any other third party holding copyright is illegal and may give rise to initiating civil and criminal proceedings against the perpetrators of this practice.

XII. Technical requirements necessary to work with the ICT system

1. Subject to the provisions set out below in paragraphs 2 and 3, Seller will endeavour to make using the Online Shop and other services available on the Online Shop Website possible with all popular web browsers and operating systems.

2. Correct use of the Online Shop requires (minimum technical requirements enabling use of the Online Shop Website):

a. Internet access;

b. using a web browser at least Microsoft Internet Explorer 8, Google Chrome 16, Mozilla Firefox 10, Opera 11 or later versions;

c. Internet access, with a capacity of at least 256 kbit/s;

d. to receive e-mail messages - having an e-mail account.

3 For proper operation of the Online Shop, it is necessary that Customer’s ICT systems have enabled JavaScript language support.

XIII. Transitional and final provisions

1. The Terms and Conditions shall be valid from the date of publication on the Online Shop Website and replace the previously applicable terms and conditions of the Online Shop, provided that the provisions set out below in paragraphs 6 to 8 shall apply accordingly.

2. To the matters not provided for in the Terms and Conditions, the relevant provisions shall apply.

3. The annexes mentioned in the text of the Terms and Conditions are an integral part hereof.

4. Seller reserves the right to amend these Terms and Conditions, in particular in the case of changes in the law (including changes in their interpretation) or to improve the functioning of the Online Shop and improve the protection of the privacy of users of the Website (Customers of the Online Shop) and prevent fraud. Amendments shall enter into force at the moment clearly indicated by Seller, but not earlier than 7 days after their announcement. Amendments to the Terms and Conditions may not violate the acquired rights of Customers who use the Online Shop.

5. Providing Customers with amendments to the Terms and Conditions will occur by posting information on the amendments to the Terms and Conditions on the Home Page of the Online Shop and in another manner as chosen by Seller ensuring their acknowledgment by Customers. The above information shall be displayed on the Home Page of the Online Shop for a period of not less than 14 Business Days.

6 The contents of these Terms and Conditions may be perpetuated through printing, copying on media or download from the Online Shop Website.

7. In case when a registered Customer (holding Customer's Account) does not accept the new contents of the Terms and Conditions, they shall notify Seller about this fact within 14 Business Days from the date of learning about changes in the Terms and Conditions. Refusal to accept the amendments to the Terms and Conditions shall result in termination of the contract for the provision of services by electronic means, subject to the parties to the contract keeping the rights acquired before the said termination.

8. Amendments to the Terms and Conditions will not apply to Orders placed prior to the displaying of the amendments on the Online Shop Website. These Orders will be executed on the basis of the terms and conditions in force at the date of placing the Order.

9.  In the event of a conflict between the provisions of the Terms and Conditions and applicable law, the provisions of the Terms and Conditions affected by the invalidity shall be replaced with those provisions, in which case the remaining provisions of the Terms and Conditions remain in force.

10. The Terms and Conditions do not limit the rights of consumers under applicable law, which provisions cannot be excluded or modified by agreement between the parties.

11. Any dispute between the Parties will be settled in an amicable way, or in the presence of an independent and impartial mediator. Consumer may also benefit from using extrajudicial method of complaint examination and redress. To take advantage of the possibility of an amicable settlement of disputes relating to online shopping, Consumer can submit their complaint also via the EU website platform ODR, available at: http://ec.europa.eu/consumers/odr/.

12. In the absence of a possibility of an amicable settlement of a dispute, including via mediation, the Court's jurisdiction will be determined according to the prevailing law

13. The Terms and Conditions shall come into force on 10 th of September 2017.
